I won my appeal court case over the bicycle helmet charges, I was in court for breaching an order to do community service work. I took with me, my melanoma diagnosis.
I spent almost 18 months in prison over this matter and suffered the injustice like a trooper. I often work outdoors in the building and construction game. When I was in my 20s I had a skin cancer removed from my nose. As a child, I never used a hat or sun screen lotion and spent nearly all weekends at the beaches and parks in Point Chev and Westmere in Auckland. Since I had the cancer I was on alert working outdoors and often wore the kind of hat recommended in the act. I see them often when driving around the city. The Government really wanted me to use a bicycle helmet so I attached a good rim, but I noticed a label inside the helmet. It stated "Make no modification" Do Not modify this safety device, to do so will void the safety certification and warranty. I tried a hat under the helmet, but that proved to be hot and reduced the view of the road. None of the other or very dew were using hats of modified helmets so I thought this law is exposing us to harm and enforcing the law could cause fear in fair skinned people like me. I decided to ditch the helmet and continue with the sunhat. Events leading to my arrest are not that interesting, except when I didn't just accept the ticket and walk home, but tried instead to evade them. They were not going to let me get away. In court I was told "we don't make the laws". Courts only decide if I am guilty or not? I didn't pay the fines, which resulted in the courts debt collection agency threatening to cancel my drivers license and deduct the fines from my Bank. I got several more tickets and some charges for resisting police The Bank was on my side, however, I had the statistics showing cyclist head injuries caused very few deaths compared to pedestrians knocked over, and motor vehicle occupant's. Why single out bicycle riders? They claim it was about saving lives? However with over 2 thousand skin cancer deaths each year a helmet law with the helmet design will cause fear and likely more harm than good. There are other factors that make the bicycle helmet compulsion a bad law, that include a drop in the overall fitness levels, an increase in obesity, broken neck & rotation brain damage caused by grabbing on the road. I tried to talk to some local journalist who didn't seem all that excited about it. They saw the Stanley knife I had hanging around my neck (for protection) I said this is because the police try to lock me up. I got charged with going armed to cause fear and locked up for 18 months. Well later I heard the news was seen by the prison inmates. When I was released people strangers were calling me the legend, a hero. One must be humble, there are others calling me a lunatic.
